TERMS & CONDITIONS

These are the general terms & conditions that apply to contract relationships that MedFile^TM S.L. (hereinafter MedFile^TM) offers in this web site.
Accepting the following the steps to buy a product / service in the MedFile^TM web site means that you agree with the general buying conditions that appear herein.

FIRST. PURPOSE
The purpose of the following general buying conditions is to distribute the products offered in the MedFile^TM web site, in exchange of money.

SECOND. CONTRACT FORMATION
The user agrees with the general buying conditions presented in this text, once he accepts and fills out the application form.

THIRD. ORDER RECEIPT, PRICE AND PAYMENT
The price for each product / service is shown in the shopping cart of the web site. The price and conditions may change, but the user will receive the price and conditions dated the moment of the order. This applies except when there is a pricing error on the web site.

MedFile^TM reserves the right to charging the order from the moment it has been received.

There were we sell physical products (not services) we must be notified of any order cancellations or changes before 12.00 (Spanish time) after the order has been placed. After this time the order is considered completed. During this period of cancellation, the customer can cancel the order with no additional costs incurred. If the order is cancelled after this period of time and it has been shipped already, MedFile^TM will charge the customer for the transport expenses incurred for the cancellation.

To receive a product / service from MedFile^TM, the user will have to pay it electronically or by bank transfer. MedFile^TM reserves the right to request a bank transfer when they decide to do so.

MedFile^TM charges the invoices in Euros at the exchange rate of the day of the shipment. Customers might be affected by the difference of the exchange rate between the moment they were charged and the moment their own bank charges them. This small difference can work for or against the benefit of the customer and can not be controlled by MedFile^TM.
As such MedFile^TM does not accept any responsibility.

FOURTH. PRODUCT WARRANTY
All products offered by MedFile^TM are warranted. If a product sold by MedFile^TM has a manufacturing fault or is broken during shipping, MedFile^TM will repair it with no extra charge, exchange it for a new one, or give a refund. In these situations, the shipping costs incurred for the exchange or return will be paid by MedFile^TM. The buyer must inform by e-mail within 7 days of receiving the order that he wishes to return a product so that the best delivery procedure can be arranged. Otherwise additional costs incurred will be the responsibility of the customer.

FIFTH. SHIPPING COSTS FOR PRODUCTS
The shipping costs for each order is shown in the shopping cart on the web site and can be seen clearly before the purchase is made.

MedFile^TM will verify that the payment has been made correctly and then will send the product the following way by post. All products in stock are delivered to your home within approximately 15 working days.

Saturday, Sunday and bank holidays are considered as non working days. If due to any error on our part, the shipping takes longer than indicated, MedFile^TM will contact the customer to notify them of this delay and will propose any alternative solutions. Maximum delivery times apply only for products in stock.

SIXTH. INVOICE/TICKET
When the final user has made a purchase, MedFile^TM will give him a ticket.
When an enterprise has made a purchase, MedFile^TM will give him an invoice.
In both cases in the invoice the taxes and the shipping costs will be broken down.
In both cases, the ticket and/or the invoice will be sent electronically unless otherwise requested.

SEVENTH. RETURNS
During the seven days after the package has been received, the buyer can return the product to MedFile^TM. The product must be in perfect condition and must not have been used. The buyer must inform by e-mail that he wants to return the product, so that the best delivery procedure can be arranged otherwise it will have to assume the incurred additional costs. In the case of a service, any user can discontinue the agreement within the first 7 days, advising MedFile^TM by certified post.

In case of the following situations

• The product is the wrong size
• We sent you the wrong product
• The product is faulty

MedFile^TM will pay the shipping costs incurred for the exchange or return.
In any other case, MedFile^TM does not assume these costs and they will be charged to the customer.

EIGTH.
MedFile^TM offers all required information about its products and about its orders.

The buyer has to fill out the order application forms following all MedFile^TM indications.
MedFile^TM will protect the information of personal details according to the law.
The buyer has to pay the price of the product with the corresponding taxes and possible shipping costs.

NINTH. GOVERNING LAW AND JURISDICTION
The contract will be interpreted, construed and enforced in all respects in accordance with the laws of Spain and you and MedFile^TM irrevocably submit to the jurisdiction of the Courts of Barcelona in Spain .
In addition to this, MedFile^TM is adhered to the Consumer Arbitration System (Sistema Arbitral de Consumo) and thus abides by The Arbitral law (Ley de Arbitraje). This system consists of a voluntary extrajudidicial procedure that is used when solving any dispute. The judgement by arbitration must be upheld and abided to the same as a judgment by a judge in a court of law.

TENTH. MINOR PROTECTION
Any purchase is only authorised to those who are of age or to minor with authorisation from a parent or guardian.

ELEVENTH. COMMITMENTS

MedFile^TM is committed to:

• Always providing truthful information, to the best of our knowledge.
• Not sending commercial information without first pointing out that they are of a commercial nature.
• Answering the questions, complaints and suggestions within two working days and, if delayed, contacting the customer to communicate a new waiting time for the answer.
• Establishing an easy procedure for complaints.
• Providing real time information regarding any order when required.
